Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Eteeka LLC(“Mobi,” “we,” “us”). They govern your access to and use of mobiforkids.comand your reservation of a Mobi smartwatch (the “Reservation”). By using the site or placing a Reservation, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site or place a Reservation.

To place a Reservation, you must be at least 18 years old, have the legal authority to enter into a binding contract, and have a shipping address in the United States or Canada. Reservations placed in violation of this section may be canceled and refunded at our discretion.

Mobi is sold by Reservation. A Reservation reserves your place in our production queue and locks in the price shown at the time of order. Reservations are not orders for shipment until we confirm the ship date.

• Deposit: a $50 per-watch deposit is charged at the time you place your Reservation. The deposit holds your spot in the production queue.
• Balance: the remaining balance of $99.99 per watch (or the applicable multi-unit pair price) becomes due when your Mobi ships. We will contact you in advance to collect the balance.
• Ship target: we currently target September 2026 for shipment. This is our good-faith estimate based on current production planning and is not a guarantee. We will notify you of any material change.
• Configuration: the band and case colors you select at Reservation will be confirmed before your watch ships. If a selected color becomes unavailable, we will offer you a comparable alternative or a refund of your deposit.

All prices on the site are in U.S. dollars and exclude applicable taxes, duties, and shipping unless stated. Pair pricing is calculated per pair: every two units in the same Reservation receive the pair price shown in the configurator; any leftover odd unit is charged at the single-unit price.

We use Stripe to process payments. By placing a Reservation you authorize Stripe to charge your selected payment method for the deposit and, in due course, the balance. Sales tax is calculated and collected where required by law at the time of charge.

We reserve the right to correct typographical errors and adjust pricing for future Reservations at any time. Adjustments will not affect Reservations already placed.

We currently ship to addresses in the United States and Canada only. Title and risk of loss pass to you when the carrier accepts the package. We are not responsible for carrier delays. You are responsible for providing an accurate shipping address; additional charges may apply for re-shipment after a failed delivery.

• Cancel before ship: you can cancel a Reservation at any time before we ship your Mobi and we will refund your deposit in full.
• 30-day satisfaction guarantee: Fully refundable up to 30 days after you receive it. Return the watch in its original condition with all packaging and accessories and we will refund the full amount you paid (deposit and balance), less any non-refundable shipping fees disclosed at the time of shipment. Email info@mobiforkids.com to start a return.
• Materially delayed ship date: if we determine we cannot ship within a reasonable time of the then-current ship target, you may request a refund of your deposit. We will process such refunds within 14 business days of receipt of your request.

Refunds are issued back to the original payment method. Bank or card processing may take additional time to reflect the refund.

You agree to use the site only for lawful purposes and only in the manner intended. You will not (i) probe, scan, or test the vulnerability of the site or any related system; (ii) attempt to gain unauthorized access; (iii) scrape, harvest, or otherwise extract data through automated means; (iv) interfere with the operation of the site or other users; or (v) use the site to send unsolicited communications.

The site, its content, design, code, trademarks, logos, and product imagery are owned by Eteeka LLC or our licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and view the site for your personal, non-commercial use. All other rights are reserved.

The site uses third-party services to operate, including but not limited to Stripe (payments), Amazon Web Services (hosting), Meta (advertising and measurement), and Mixpanel (analytics). Your use of those services is also subject to their own terms and policies. We are not responsible for the practices of third parties.

The site and the reservation service are provided “as is” and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or secure; that defects will be corrected; or that ship dates, configurator availability, or pair-pricing eligibility will remain unchanged. Statements about Mobi's capabilities, ship windows, or coverage are forward-looking and may change.

To the maximum extent permitted by law, Eteeka LLC, its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with the site, the reservation service, or these terms.

Our total cumulative liability arising out of or relating to these Terms or your Reservation, regardless of theory, is limited to the greater of (a) the total amount you have paid to us in the twelve months immediately preceding the event giving rise to the claim, or (b) $50. Some jurisdictions do not allow these limitations, so they may not apply to you in full.

You will defend, indemnify, and hold harmless Eteeka LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your misuse of the site.

These Terms and any dispute arising out of or related to them or the site are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. The exclusive venue for any dispute not subject to informal resolution under Section 14 is the state and federal courts located in Florida, and you and we consent to personal jurisdiction in those courts.

Before filing any claim, you agree to first contact us at info@mobiforkids.com with a description of your dispute. We will work in good faith to resolve the matter within 30 days. If we cannot resolve it informally, either party may bring the matter before the courts identified in Section 13.

You and we each agree that any claim arising out of or related to these Terms must be brought in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

We may update these Terms from time to time. If a change is material, we will update the Effective date at the top of this page and, where appropriate, provide additional notice. Your continued use of the site after the new effective date means you accept the updated Terms. Changes to refund or pricing terms will not affect Reservations already placed.

• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the site and the Reservation, and supersede all prior agreements.
• Severability: if any part of these Terms is held unenforceable, the remainder will continue in full effect.
• No waiver: our failure to enforce a right is not a waiver of that right.
• Assignment: you may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control.
